1. Acceptance of Terms

By accessing or using SivarJobs ("Platform", "Service", "we", "us"), you ("User", "you") agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Platform.

2. Use License and Data Rights

By creating an account and using SivarJobs, you grant us a worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable license to:

• Use, reproduce, modify, adapt, publish, translate, and distribute your Content (including profiles, applications, messages, resumes, and any other information you provide) in any media or format
• Create derivative works from your Content for platform improvement, training AI models, analytics, and marketing purposes
• Display your profile information, work history, and qualifications to employers and other users as part of our matching service
• Share your application materials, voice recordings, assessments, and related data with prospective employers
• Use aggregated and anonymized data for research, analytics, and platform improvement
• Store, process, and transmit your data across our servers and third-party services globally

3. User Content and Responsibilities

You represent and warrant that:

• All information you provide is accurate, current, and complete
• You own or have the necessary rights to all Content you submit
• Your use of the Platform does not violate any applicable laws or regulations
• You will maintain the security of your account credentials
• You authorize SivarJobs to conduct background checks, verify your employment history, and contact references

4. Agent (Job Seeker) Specific Terms

As a job seeker on SivarJobs, you acknowledge and agree that:

• Your profile, resume, voice recordings, and assessment results will be visible to employers
• We may use your profile as part of marketing materials (with anonymization where appropriate)
• Employers may contact you directly through the Platform
• We are not responsible for job offers, employment terms, or employer conduct
• Voice verification recordings may be analyzed by AI and reviewed by our team
• Psychological assessments and CEFR certificates are provided for matching purposes and do not guarantee employment

5. Employer Specific Terms

As an employer on SivarJobs, you acknowledge and agree that:

• You are responsible for all job postings and their compliance with employment laws
• You will not discriminate based on protected characteristics
• All candidate data accessed through the Platform must be used solely for recruitment purposes
• You will maintain confidentiality of candidate information
• Subscription fees are non-refundable except as stated in our refund policy
• We may showcase your company and job postings in marketing materials

6. Payment Terms

For paid services:

• All payments are processed securely through PayPal
• Subscription fees are billed monthly or annually as selected
• Agent verification ($1) is a one-time, non-refundable payment
• Failed payments may result in service suspension or downgrade
• We reserve the right to modify pricing with 30 days notice
• Refunds are provided only as specified in our refund policy (30-day money-back guarantee for first-time subscribers)

7. Prohibited Activities

You may not:

• Provide false or misleading information
• Scrape, harvest, or collect user data without authorization
• Use the Platform for spam, fraud, or illegal activities
• Circumvent or manipulate our matching algorithm
• Create multiple accounts to abuse platform features
• Reverse engineer or attempt to access source code
• Harass, abuse, or harm other users
• Post job listings for illegal activities or multi-level marketing schemes

8. Third-Party Services and Integrations

SivarJobs integrates with and uses various third-party services. By using our Platform, you acknowledge and agree to the following:

8.1 Google Services

• Google OAuth: When you sign in with Google, you authorize us to access your Google profile information (name, email, profile photo) and agree to Google's Terms of Service and Privacy Policy. We are not responsible for Google's data practices or service availability.
• Google Meet: Interview scheduling may use Google Meet. We are not responsible for Google Meet functionality, availability, security, or any issues arising from video interviews conducted through Google services.
• Google Calendar: Calendar integrations may sync interview schedules. You authorize us to read and write calendar events on your behalf.

8.2 OpenAI and AI Services

• We use OpenAI (including GPT-4 Vision) and other AI services for voice analysis, assessment generation, matching algorithms, content moderation, and resume parsing
• AI Resume Parser: When you upload your resume (PDF or image), we use OpenAI GPT-4 Vision to automatically extract your work experience, skills, education, and other profile information. By using this feature, you authorize us to send your resume data to OpenAI's servers for processing. Your resume data may be used by OpenAI to train and improve their AI models according to their data usage policies.
• Your voice recordings, profile data, resume documents, and content may be processed by these AI services
• AI-generated assessments, scores, recommendations, and parsed resume data are automated and may contain errors or inaccuracies
• You are responsible for reviewing and correcting any AI-parsed information before using it in job applications
• We make no warranties about AI accuracy, reliability, completeness, or fitness for any particular purpose

8.3 LinkedIn Profile Import

• We offer LinkedIn OAuth integration to allow you to quickly import your professional profile information
• When you connect your LinkedIn account, you authorize us to access your LinkedIn profile data including work experience, education, skills, certifications, and basic profile information
• You agree to LinkedIn's Terms of Service and Privacy Policy. We are not responsible for LinkedIn's data practices or service availability
• LinkedIn data is used solely to populate your SivarJobs profile and is not stored separately or used for other purposes
• You can revoke LinkedIn access at any time through LinkedIn's privacy settings

8.4 PayPal Payment Processing

• All payments are processed through PayPal. You agree to PayPal's Terms of Service and Privacy Policy
• We do not store complete payment card information
• Payment disputes must be resolved through PayPal's dispute resolution process
• We are not responsible for PayPal service interruptions, processing delays, or payment failures

8.5 Email and Communication Services

• We use third-party email service providers (e.g., SendGrid, AWS SES) for transactional and marketing emails
• Email delivery is not guaranteed; we are not liable for undelivered, delayed, or intercepted emails
• You authorize us to send emails to your provided address for platform notifications, marketing, and service updates

9. Assessments and Certificates Disclaimer

9.1 Voice Verification and CEFR Certificates

• CEFR certificates are generated internally by our AI systems and are NOT official certifications from recognized testing authorities (such as Cambridge, IELTS, TOEFL, or DELE)
• These certificates have NO official recognition by educational institutions, government agencies, or professional certification bodies
• Voice verification assessments use AI technology which may produce inaccurate or biased results
• Results are estimates based on limited voice samples and do not constitute comprehensive language proficiency evaluation
• We make NO WARRANTIES about the accuracy, validity, or reliability of voice assessments or CEFR level determinations
• Employers and candidates use these scores at their own risk and should conduct independent verification if official certification is required
• We are NOT liable for any employment decisions, rejections, or consequences arising from voice verification scores or CEFR certificates

9.2 Psychological Assessments

• Assessments are automated questionnaires designed for job matching purposes only
• Results do NOT constitute psychological diagnosis, therapy, counseling, or medical advice
• Assessments are NOT suitable for clinical, diagnostic, or therapeutic purposes
• Results may be inaccurate, incomplete, or not reflective of actual personality, mental health, or job performance
• We make NO WARRANTIES about psychological assessment accuracy, validity, or reliability
• Assessment results should not be used as the sole basis for employment decisions
• We are NOT liable for any employment outcomes, workplace issues, or personal consequences arising from psychological assessment results
• If you need actual psychological services, consult a licensed mental health professional

9.3 No Professional Advice

SivarJobs does NOT provide:

• Legal advice or employment law guidance
• Immigration or work authorization advice
• Tax or financial advice
• Career counseling or professional coaching
• Medical or mental health services
• Educational or academic certification

Consult appropriate licensed professionals for these services.

10. Intellectual Property

All Platform content, features, and functionality (including but not limited to software, text, designs, logos, and trademarks) are owned by SivarJobs and are protected by international copyright, trademark, and other intellectual property laws. Our AI matching algorithms, voice verification technology, and assessment methodologies are proprietary and confidential.

11. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SivarJobs is a platform connecting job seekers and employers. We are not:

• An employment agency or recruiter
• Responsible for employment decisions, offers, or terms
• Liable for employer or candidate conduct
• Guaranteeing job placement or hiring success
• Responsible for accuracy of user-submitted information

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

12. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspicious activity, or at our sole discretion. Upon termination, your right to use the Platform ceases immediately. We may retain your data as required by law or for legitimate business purposes.

13. Indemnification

You agree to indemnify, defend, and hold harmless SivarJobs, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Platform, (b) violation of these Terms, (c) violation of any third-party rights, or (d) any Content you submit.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or Platform notice. Continued use after changes constitutes acceptance of modified Terms. It is your responsibility to review these Terms periodically.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of El Salvador without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in El Salvador. You waive any right to participate in class action lawsuits.
